2. TROs from other courts snubbed by BIR

Bureau of Internal Revenue (BIR) declined the issuance of temporary restraining order (TRO) filed by other courts apart from Court of Tax Appeals (CTA) concerning their tax collections as conveyed by BIR Commissioner Joel Tan-Torres in a press conference held on Friday.

Judges from Regional Trial Court (RTC) in Makati and Davao City have questioned the collection activities done by the BIR and had issued them with TROs.

In the said conference, BIR, as stated by Commissioner Tan-Torres, has just issued a Revenue Memorandum Order No. 42-2010 referring to the Tax Code that only CTA has the authority to prohibit BIR from their activities regarding tax collections.

Prohibitions other than orders from CTA must be cancelled and annulled, Commissioner Tan-Torres added.

BIR also affirmed that they are capable of filing an administrative case against the illegal acts perpetrated by judges in the said areas.

“We have duly notified them of the illegality of their action and are preparing the necessary steps to prevent the occurrence of these acts in the future. We are warning all parties, including RTC judges, to desist from doing these illegal acts,” commented by BIR Commissioner Tan-Torres. (Camille Marie Ponce and Rose Anne Valledo)
